1. Agreement to Terms

By accessing or using the services provided by DNA Web Studio ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services

DNA Web Studio provides professional website design and development services for businesses. Our services include:

  • Custom website design and development
  • Website hosting and maintenance plans
  • SEO optimization
  • Third-party integrations (booking systems, chat widgets, etc.)
  • Content creation and copywriting

3. Pricing and Payment

3.1 Website Packages

We offer three website packages: Launch Website ($997), Growth Website ($1,997), and Authority Website ($2,997). Prices are subject to change without notice, but any changes will not affect orders already placed.

3.2 Monthly Care Plans (Mandatory)

All website packages require an active monthly care plan for ongoing website operation. The care plan is mandatory and includes hosting, security, SSL certificates, backups, performance optimization, SEO maintenance, and monthly website edits. The first month is provided free of charge; recurring billing begins 30 days after purchase.

Important: Your website cannot operate without an active care plan. Upon cancellation of your care plan:

  • Your website will be taken offline within 7 days of cancellation
  • You will no longer be able to request edits or changes to your website
  • Hosting, SSL certificates, and security monitoring will be discontinued
  • Daily backups and performance optimization will stop
  • SEO maintenance and updates will cease
  • Technical support will no longer be available

Care plans can be cancelled with 30 days written notice. Upon cancellation, we will provide you with a copy of your website files upon request, but you will be responsible for finding alternative hosting and maintaining the website yourself.

3.3 Payment Terms

Full payment is required at the time of purchase. We accept major credit cards and offer buy now, pay later options through Klarna. All payments are processed securely through Stripe.

4. Project Timeline and Delivery

Estimated delivery times are:

  • Launch Website: 24-48 hours
  • Growth Website: 5-7 business days
  • Authority Website: 7-10 business days

Delivery times begin once we receive all required information through our onboarding questionnaire. Delays in providing content, images, or feedback may extend the delivery timeline.

5. Revisions

All packages include 3 rounds of revisions. A revision round consists of feedback provided within a single communication. Additional revisions beyond the included 3 rounds may be subject to additional fees. Major structural changes or scope changes after the initial design is approved may require a change order with additional costs.

6. Client Responsibilities

To ensure successful project completion, clients are responsible for:

  • Providing accurate business information and content
  • Supplying logos, images, and brand assets (or approving stock images)
  • Responding to requests for information within 48 hours
  • Providing timely feedback during the review process
  • Ensuring all provided content does not infringe on third-party rights

7. Intellectual Property

7.1 Client Content

You retain all rights to content you provide, including text, images, logos, and other materials. You grant us a license to use this content solely for the purpose of creating your website.

7.2 Website Ownership

Upon full payment, you own the final website design and content. However, we retain the right to use the website in our portfolio and marketing materials unless otherwise agreed in writing.

8. Refund Policy

We stand behind our work with a satisfaction guarantee:

  • Before Design Begins: Full refund if cancelled within 24 hours of purchase and before any design work has started.
  • During Design Phase: 50% refund if cancelled after design work has begun but before final delivery.
  • After Delivery: No refunds after the website has been delivered and approved, or after 14 days from delivery, whichever comes first.

Monthly care plan fees are non-refundable but can be cancelled with 30 days notice after the initial 3-month commitment period.

9. Limitation of Liability

To the maximum extent permitted by law, DNA Web Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid for the services in question.

10. Third-Party Services

Our services may integrate with third-party platforms (such as booking systems, payment processors, or analytics tools). We are not responsible for the functionality, availability, or terms of these third-party services. Any fees associated with third-party services are the client's responsibility.

11. Website Hosting

Websites are hosted on our managed hosting platform as part of your monthly care plan. We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any losses resulting from hosting downtime or technical issues beyond our control.

12. Termination and Care Plan Cancellation

Either party may terminate the service agreement with 30 days written notice.

12.1 Effects of Care Plan Cancellation

Because the care plan is mandatory for website operation, cancellation will result in the following:

  • Website Offline: Your website will be taken offline within 7 days of the cancellation effective date
  • No Edits or Changes: You will no longer be able to request any modifications to your website
  • Loss of Hosting: Your website will no longer be hosted on our servers
  • Security Discontinued: SSL certificates, security monitoring, and malware protection will be terminated
  • No Backups: Daily backups will stop; existing backups will be deleted after 30 days
  • SEO Maintenance Stops: Ongoing SEO optimization and updates will cease
  • No Support: Technical support and priority assistance will no longer be available

12.2 Website File Transfer

Upon cancellation, you may request a copy of your website files. We will provide the static files within 14 days of your request. Please note that the website may require technical expertise to set up on a new hosting provider, and we do not provide support for self-hosted websites.

12.3 Reactivation

If you wish to reactivate your website after cancellation, a reactivation fee may apply depending on the time elapsed and the condition of your website files. Reactivation is subject to availability and current pricing.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new terms.
